These Terms of Service (“Terms”) govern your use of Help911.ca (“Help911”, “the Service”), owned and operated by BeFit Health & Fitness Inc. (“BeFit”, “we”, “our”, “us”). By subscribing to or using Help911.ca, you agree to these Terms, our Privacy Policy, and all policies integrated herein.
If you do not agree, do not use the Service.
1. Description of the Service
Help911.ca provides a daily check-in and emergency-notification service. At your selected time, our system attempts to contact your loved one by phone or SMS. If the loved one does not respond after multiple attempts, Help911 notifies the designated emergency contacts according to your chosen preferences.
Help911.ca is not a medical service, not a life-monitoring system, not a 911 replacement, and not a substitute for professional care or emergency responders.
2. Eligibility
To subscribe to Help911.ca, you must:

Be 18 years of age or older

Have legal authority to register the loved one for the service

Provide truthful and complete information

Agree to these Terms and our Privacy Policy
3. User Responsibilities
3.1 Accurate Information
You must provide up-to-date and correct details for:

Subscriber information

Loved one information
-
Emergency contacts
3.2 Consent
By signing up, you confirm:

The loved one has consented to daily calls or SMS
-
Emergency contacts have consented to receive potential alerts
3.3 Updating Information
You agree to update details immediately if:

Phone numbers change
-
The loved one’s address changes
-
Emergency contacts change
-
Their health or living situation changes
3.4 Service Understanding
You acknowledge that:

The Service cannot guarantee emergency intervention

Telecom carriers can experience outages
-
It is your responsibility to ensure your loved one’s overall safety
4. Service Limitations
Help911.ca does not:

Dispatch emergency responders
-
Provide medical advice or monitoring
-
Guarantee loved one safety
-
Ensure emergency contacts respond
-
Track individuals in real time
Help911.ca is dependent on:

Cellular and phone carriers
-
Device availability (e.g., phone on silent, dead battery, call blocking)
-
Correct user-provided information
These dependencies may affect service performance.
5. Fees, Billing, and Integrated Refund Policy
5.1 Subscription Fees
Fees are displayed on Help911.ca and may vary by plan or region.
5.2 Automatic Billing
Subscriptions automatically renew monthly or annually unless canceled.
5.3 Payment Processing
Payments are handled by secure third-party processors (e.g., Stripe, PayPal).
BeFit Health & Fitness Inc. does not store credit card information.
5.4 Failed Payments
If a payment fails, we may:

Retry the payment

Suspend or cancel the service
5.5 Refund Policy (Integrated)
Refunds are issued as follows:

Monthly subscriptions: Non-refundable.

Annual subscriptions: Prorated refunds may be issued only if requested within the first 30 days.

Partial months of service

Service interruptions due to telecom providers

Incorrect information submitted by the user

Missed alerts caused by unreachable devices or network issues

Refunds are issued only to the original payment method.
6. Emergency Notification Protocol
If a loved one does not respond:

Help911 attempts multiple check-in calls or SMS.

After non-response, Help911 notifies your emergency contacts by call and/or SMS.

Once notification is sent, Help911’s responsibility ends.
Help911 does not continue monitoring or contacting emergency services.
7. Acceptable Use
You agree not to:

Use the Service for unlawful purposes

Provide false or misleading information
-
Attempt to interfere with system operations
-
Reverse-engineer or attempt unauthorized system access
Violations may result in immediate termination.
8. Privacy
Your personal information is handled pursuant to our Privacy Policy, which forms part of these Terms.
Using Help911.ca indicates your agreement to:

The collection and use of data as outlined

The contacting of loved ones and emergency contacts per your instructions
9. Data Storage, Security & Limitations
We use reasonable administrative, technical, and physical safeguards. However:

No system can eliminate all risk

You acknowledge inherent risks in electronic communication and storage

We may modify, suspend, or discontinue any part of the Service, including:

11. Integrated Disclaimer
The Help911.ca service is provided strictly on an “as-is” and “as-available” basis.
By using the Service, you agree to the following disclaimers:

Help911 is not:

Emergency medical services

A replacement for wellness visits, caregivers, or family oversight
11.2 No Guarantee of Contact
We do not guarantee:

A loved one will answer

Emergency contacts will respond

Telecom providers will deliver calls/SMS without delays or failure
11.3 No Liability for Consequences
We are not responsible for:

Injuries, damages, or outcomes resulting from missed responses

Delayed or failed notifications
-
Incorrect or outdated contact information
-
Device issues (battery, ringer off, network outage, etc.)

Any event that occurs before, during, or after attempted notifications
Your use of Help911.ca acknowledges acceptance of these limitations.
12. Limitation of Liability
To the maximum extent allowed by law:
BeFit Health & Fitness Inc. and Help911.ca shall not be liable for:

Direct, indirect, incidental, consequential, or punitive damages

Loss of data

Personal injury, death, or property damage

Losses arising from service interruptions, telecom failures, or emergency contact inaction
Your sole remedy for dissatisfaction with the Service is to discontinue use.
13. Indemnification
You agree to indemnify and hold harmless BeFit Health & Fitness Inc., its directors, employees, contractors, and partners against any claims arising from:

14. Termination
